What To Know About The H-1B Visa Filing Season For FY2023

Once again, the H-1B visa filing season is upon us and all aspirants for the 2023 fiscal year are in a mad rush to make sure they get things done on time. The process is already underway, and you should have submitted your registrations by now. That doesn’t mean the race is over though. There’s still plenty to be done for the H-1B visa filing season for FY2023!

1. Important Dates

The initial registration period for the cap subject H-1B visa for FY2023 was from noon on March 1, 2022 to noon on March 18, 2022. New accounts could be created as early as noon on February 21, 2022. This gave both employers and employees enough time to get their paperwork together and submit their applications. 


If the USCIS receives more registrations than the annual cap on the H-1B visas, it will conduct a lottery. The results of the same will be declared on March 31, 2022, and petitions can be filed from April 1, 2022. The window remains open for 90 days after the lottery results are declared. 


2. Online Account

An electronic registration process was implemented by the USCIS in 2020. All petitioners for the H-1B visa filing season FY2023 should create a myUSCIS online account. You have to pay a US$10 registration fee for each registration. Without this account, you won’t be able to enter the selection process and have a chance to get the H-1B visa.


3. Registration Numbers

For each application submitted during the H-1B visa filing season FY2023, USCIS will assign a registration number, also called an Alien Number or A-Number. This number can only be used to track the registration. You won’t be able to track the case status with this number


4. Multiple Beneficiaries

If employers or representatives want to submit multiple registrations for different beneficiaries, they can do so in a single online session. They can get an account which allows them to prepare, edit, and draft multiple registrations. This can be done before making the final payments and submitting the forms. 


5. H-1B Cap

The current H-1B visa cap for FY2023 stands at 65,000. The new visas are issued each fiscal year, which starts on October 1. Apart from the cap number, an additional 20,000 H-1B visas are granted to those beneficiaries who have a Master’s degree or higher from a US institute of higher education. 


6.Duplicate Entries

A common mistake that many H-1B visa aspirants make is to submit multiple registrations in one fiscal year. According to the USCIS site, if a petitioner has submitted more than one registration for the same beneficiary, all registrations submitted by the petitioner for that beneficiary are removed once the initial registration period closes. Ensure that you remember this during the H-1B visa filing season for FY2023.
