At HiCounselor, we understand that you trust us with your information. We value and respect the privacy of individuals who use our website and/or mobile application, and want to transparently explain our privacy practices. Below, we describe what Personally Identifiable Information ("PII") we collect from you when you choose to use our services, as well as how and why we gather, store, share, use and safeguard your PII. We also describe the controls and choices you have regarding when and how you choose to share this information.

Please read this Privacy Policy carefully, as it sets out the essential details relating to your PII relationship with HiCounselor. The aim of our Privacy Policy is to ensure that you understand what PII we collect about you, explain the ways we collect and use the PII you share with us in order to give you a great experience when you use HiCounselor, and explain your rights and choices in relation to the PII we collect and process about you and how we will protect your privacy.

This Policy applies to all HiCounselor services and any associated services. By using our website and/or mobile application, you consent to the data and privacy practices described in this Privacy Policy, as well as our general Terms of Use and Arbitration Agreement. IF YOU DO NOT AGREE WITH THE TERMS OF THIS PRIVACY POLICY, PLEASE DO NOT ACCESS THE HI COUNSELOR WEBSITE AND/OR MOBILE APPLICATION.

From time to time, we may develop new services, offer additional services and/or make changes to this Privacy Policy. If we make any material changes to the way in which we collect or process your PII, we will provide you with more information and additional terms or policies through the HiCounselor website, mobile application, by email, or other communication. We encourage you to read this Privacy Policy periodically to stay up-to-date on our privacy practices. As long as you use the HiCounselor website and/or mobile application, you are agreeing to this Privacy Policy and any updates we make to it.

Information We Collect

1. Information You Provide to Us

This may include:

  1. Registration Information. When you sign up for a HiCounselor account, you give us your name, company name, job title, email address, mailing address and phone number. Upon registration, we may also ask to get basic information from your LinkedIn profile like your gender, education, employment history, profile photo, and LinkedIn connections.
  2. User Profile Information. When you join the HiCounselor community, you will be asked to create a HiCounselor Profile to share information about yourself and make counselor/job seeker connections. You can share as little or as much as you want in your Profile. Your name is always part of your Profile. Read more below in "Your Choices" to learn how you can make changes to your Profile and related HiCounselor account information.
  3. Demographic Data. We may collect demographic information about you, including through user surveys.
  4. Payment Information. When you add a credit card or payment method to your HiCounselor account, a third party gateway provider that handles payment for us will receive your credit card information. To keep your financial data secure, we do not store or process transaction and/or credit card information on our servers.
  5. Communications. We may collect information if you contact us directly. For example, when you sign up for our newsletter, respond to a survey or marketing communication, or contact HiCounselor's customer support service, we will receive your name, email address, phone number, the contents of the message or attachments you may send to us, and any other information you choose to provide.
2. Information We Collect When You Use HiCounselor
  1. Transaction Information. We collect transaction details related to your use of HiCounselor, including the date and time counselor/job seeker services are rendered, any amount charged or collected for counselor/job seeker services, and any related payment method information.
  2. Usage Information. We collect information about how you interact with HiCounselor. To help us understand how you use our services and to help us improve them, we receive information about your interactions with HiCounselor, like the pages or other content you view, your actions on the website and/or mobile application, pages viewed, other system activity, and the dates and times of your visits.
  3. Device Information. We may collect information about the devices you use to access HiCounselor, including IP address, web browser type, mobile operating systems and versions, phone carrier and manufacturer, application installations, software, file names and versions, preferred languages, unique device identifiers, serial numbers, device motion information, and mobile network information.
  4. Communications Data. We enable counselors and job seekers to communicate with each other and HiCounselor through the HiCounselor website and/or mobile application. To provide this service, HiCounselor receives some information regarding the messages exchanged, including the date and time of the message, and the content of the communications. HiCounselor may also use this information for customer support services (including to resolve disputes between counselors and job seekers), for safety and security purposes, to improve our services and for analytics.
  5. "Cookies." "Cookies" are small text files that are stored on your browser or device by websites, applications, online media, and advertisements. HiCounselor uses "cookies" and other similar technologies for purposes such as: authenticating users, remembering user preferences and settings, determining the popularity of content, delivering and measuring the effectiveness of advertising campaigns, and analyzing site traffic and trends. We do not, however, use "cookies" for tracking purposes. Read more below in "Your Choices" to learn about the ways in which you can choose to have your computer warn you each time a "cookie" is being sent, or disable "cookies" altogether.
3. Information From Other Sources
  1. Unlike many other websites and mobile applications, HiCounselor does not collect PII from third parties. We do not include or offer third party products or services on our website or mobile application, and we do not sell, trade, or otherwise transfer any user's PII to any third-party outside services. Additionally, we do not allow third-party behavioral tracking.
  2. We have not enabled Google AdSense on the HiCounselor website, however we may do so in the future.
  3. HiCounselor honors Do Not Track signals and does not track, plant "cookies," or use advertising when a Do Not Track browser mechanism is in place.

How We Use the Information We Collect

HiCounselor collects and uses information to personalize your experience and learn more about the type of content and product offerings in which you are most interested. We also use the information we collect to:

  1. Create and update your account and Profile.
  2. Verify your identity.
  3. Provide, improve, expand, and promote the HiCounselor platform.
  4. Analyze and monitor how the HiCounselor community uses our website and/or mobile application. Analyzing content and information (including emails, posts, attachments and other communications) when you use our services allows us to deliver, personalize and develop relevant features, content and services.
  5. Enable communications to and between counselors and job seekers.
  6. Personalize the HiCounselor experience for you and your connections.
  7. Process and facilitate transactions and payments.
  8. Provide you with customer support.
  9. Find and prevent fraud.
  10. Enhance the safety and security of our users and services. Additionally, to respond to any safety and security issues that may arise and requests from government authorities.
  11. Perform internal operations necessary to provide our services, including to troubleshoot software bugs and operational problem and to conduct data analysis and research.
  12. Investigate or address claims or disputes relating to your use of HiCounselor's services, or as otherwise allowed by applicable law, or as requested by regulators, government entities, and official inquiries.

How We Share the Information We Collect

Some of HiCounselor's services and features require that we share information with other users or at your request. We may also share your information for legal reasons or in connection with claims or disputes

HiCounselor may share the information we collect:

  1. With Other Users.For example, if you are a counselor, we may share your first name, company name, and job title with job seekers. Similarly, if you are a job seeker, we may share your first name, employment history, and current job title with counselors
  2. At Your Request. For example, if you are a counselor who requested that HiCounselor connect you with job seekers looking to find employment at your company, we may share your information with relevant job seekers. Similarly, if you are a job seeker and you requested that HiCounselor connect you with counselors working at a specific company, we may share your information with relevant counselors.
  3. With the General Public When You Submit Content to a Public Forum.HiCounselor loves to hear from its users, including through public forums such as social media and blogs. When you communicate with us through those channels, your communications may be viewable by the public.
  4. For Legal Reasons or in the Event of a Dispute.HiCounselor may share your information if we believe it is required by applicable law, regulation, legal requirement or government request, or where the disclosure is otherwise appropriate due to safety or similar concerns. This includes sharing your information with law enforcement officials, government authorities, or other third parties as necessary to enforce our Terms of Service, Arbitration Agreement, user agreements, or other policies in order to protect the rights, property or safety of the HiCounselor community. This also includes sharing your information with others in connection with, or during negotiations of, any merger, sale of company assets, restructuring, financing, or acquisition of all or a portion of HiCounselor by or into another company
  5. With Your Consent. HiCounselor may share your information other than as described in this policy if we notify you and you consent to the sharing.
Data Collection and Deletion

HiCounselor keeps your PII only as long as necessary to provide you with HiCounselor services and for legitimate and essential business purposes, such as complying with our legal obligations and resolving disputes. We keep your PII, such as your employment history, company name, and job title, for as long as you are a user of the HiCounselor services.

Users may request deletion of their accounts at any time. Following such request, HiCounselor deletes the PII that it is not required to retain, and restricts access to or use of any PII that it is required to retain. HiCounselor may be legally required or permitted to retain your PII in the following circumstances: if there is a situation in which there is an unresolved claim or dispute relating to your account; to enforce our Terms of Service or Arbitration Agreement; and where doing so is necessary for our legitimate business interests, such as fraud prevention or maintaining the security of our users.

Your Choices

Email Subscriptions. You can always unsubscribe from our commercial or promotional emails, but we will continue to send you transactional and relational emails about your account use of the HiCounselor website. Read more below in "Other: CAN-SPAM Act" to learn about how you can unsubscribe from HiCounselor commercial emails.

Text Messages. You may opt out of receiving text messages from HiCounselor by contacting us at [email protected]

Push Notifications. You can opt out of receiving push notifications through your device settings. Please note that opting out of receiving push notifications may impact your use of HiCounselor services.

Account Information. You can review and edit certain account and personal information in your HiCounselor Profile at any time by logging into your account on the HiCounselor website and/or mobile application, https://hicounselor.com. If you would like to terminate your HiCounselor account, please contact us at [email protected]. If you choose to terminate your account, we will deactivate it for you but may retain information from your account for a certain period of time and disclose it in a manner consistent with our practices under this Privacy Policy. Additionally, please note that a user can always choose to visit the HiCounselor website and/or mobile application anonymously by navigating our services without logging into their account.

"Cookie" Opt-Out. You can always choose to have your computer warn you each time a "cookie" is being sent, or you can choose to turn off all "cookies." This is done through your browser settings. Since not all browsers look the same, consult your browser's Help Menu to learn the correct way to modify your "cookies." Please note, however, if you turn "cookies" off, some of the features that make your HiCounselor experience more efficient may not function properly.

Other

Data Security. At HiCounselor, we are committed to protecting our users' PII. We use regular Malware scanning and do not use vulnerability scanning and/or scanning to PCI standards. Your PII is contained behind secured networks and can only be accessed by a limited number of persons with special access rights to our system. In addition, all sensitive information including any credit card information you supply is encrypted via Secure Socket Layer (SSL) technology.

Should a data security breach occur on HiCounselor's website and/or mobile application, we will notify you via email within seven days of such a breach, as well as promptly notify the appropriate authorities. This practice is in accordance with the Fair Trade Commission ("FTC") Fair Information Practice Principles. HiCounselor also agrees to comply with the FTC Individual Redress Principle, which stipulates that individuals have the right to legally pursue their enforceable rights against data collectors and processors who fail to adhere to the law.

Please note that even though we take reasonable precautions to protect your data, no security measures can be completely secure, and we cannot guarantee the security of your data.

Children's Privacy. In accordance with the Children's Online Privacy Protection Act ("COPPA"), HiCounselor is not directed or specifically marketed to children, and we do not knowingly collect PII from children under the age of 13. If we find out that children under the age 13 have given PII to HiCounselor, we will take steps to delete that information. If you believe that a child under the age of 13 has provided HiCounselor with PII, please contact us at [email protected].

CAN-SPAM Act. In accordance with the FTC-enforced CAN-SPAM Act, HiCounselor has adopted certain policies regarding its commercial emails. HiCounselor agrees that when we send out commercial emails related, but not limited to, advertisements or promotions of a commercial product or service, we will: identify the email as an advertisement in a reasonable way; include the physical address of our business postal address/P.O. Box; not use false or misleading subject lines or email addresses; monitor third-party email marketing services for compliance, if they are used; include an explanation of how recipients can opt out of receiving future HiCounselor commercial emails; allow recipients to unsubscribe to HiCounselor commercial emails by using a link at the bottom of each email; and honor opt-out/unsubscribe requests within ten business days of receipt.
